On March 31, 2023, the Ministry of Commerce and Industry of India issued a notice stating that it has made an affirmative final anti-circumvention determination on polyester high tenacity polyester yarn (HighTenacityPolyesterYarn) originating from or imported from China, finding that the Chinese product in question has undergone a change in description, name or composition to circumvent the existing anti-dumping duties, and therefore proposing to extend the scope of duties on the Chinese product in question to The current anti-dumping measures on polyester high-elastic yarn and the effective period (ending on July 8, 2023) are also applicable to the following products. The Indian customs code for the products in question is 54022090.
1. less than 1000 deniers but more than 840 deniers high tenacity polyester yarn, including binder activation and other yarns. Except for yarns of 840 deniers and below (when imported within the allowable tolerance of 2.4%).
2. High-tenacity polyester yarns greater than 6000 deniers but less than 7000 deniers. Except for yarns of 7000 deniers and below (when imported within 2.4% of the allowable tolerance).
3. Binder activated high tenacity polyester yarn (PUIIII) greater than 1000 deniers but less than 1300 deniers. Except for 1300 denier yarns (when imported within 2.4% of the allowable tolerance).
On June 15, 2017, the Indian Ministry of Commerce and Industry initiated an anti-dumping investigation against polyester high-tenacity yarn originating from or imported from China.
On July 9, 2018, the Indian Ministry of Finance issued Circular No. 35/2018-Customs(ADD), deciding to impose anti-dumping duties of USD 0 to USD 528 per metric ton on the products involved in China, valid for 5 years until July 8, 2023.
On July 27, 2022, the Ministry of Commerce and Industry of India issued a notice stating that an anti-circumvention investigation was initiated on polyester high-elastic yarn originating from or imported from China upon an application submitted by RelianceIndustriesLimited, a domestic enterprise in India, to examine whether the products involved have undergone changes in description, name or composition to circumvent anti-dumping duties.
On September 30, 2022, the Ministry of Commerce and Industry of India issued a notice stating that the first anti-dumping sunset review investigation was initiated on polyester high-tenacity yarn originating from or imported from China upon an application submitted by RelianceIndustriesLimited, a domestic enterprise in India. The product in question is also known as polyester industrial yarn (PIY) or industrial yarn (IDY).
The investigation does not include the following products: yarns of less than 1000 deniers, yarns of more than 6000 deniers, twisted yarns, colored yarns, bonded active yarns of more than 1000 deniers, and yarns with high modulus low shrinkage (HMLS) properties.
